Rutgers University police will not have to immediately surrender the files on 50 internal affairs investigations to a former police officer who is alleging in a lawsuit that he was discriminated against and fired because he is Hispanic.

A two-judge Appellate Division panel ruled Aug. 31 that a trial judge erred in ordering the university to turn over the files to plaintiff Wilfredo Padilla Jr. as part of discovery in his lawsuit.
