Despite what it said was an erroneous jury charge on the “mode of operation” doctrine, a New Jersey appeals court has refused to disturb nearly $500,000 in damages awarded to an octogenarian and his wife after he was injured in the parking lot of his country club.
A two-judge Appellate Division panel said the erroneous jury charge was not reason enough to overturn the verdict.
