01-2-8119 Dep’t of Human Serv. v. Anderson, App. Div. (per curiam) (9 pp.) Appellant appealed the final decision of the director of the Office of Program Integrity and Accountability in the Division of Developmental Disabilities revoking her license to operate a Community Care Residence. Appellant’s license had been suspended after an investigation substantiated the allegations of abuse and neglect made by the two temporary residents appellant cared for during a six-day period in April 2011. She failed to comply with certain specifically described training required for its reinstatement. The panel affirmed, finding that appellant’s disagreement with the findings of the investigation that concluded she neglected two residents and failed to provide the required medication did not relieve her of the responsibility to comply with this training requirement and her refusal to comply with repeated requests to attend this training could not be condoned. As appellant received clearly worded written notices warning her that she was facing revocation of her license if she did not comply, the panel had not legal authority to overturn or otherwise interfere with the agency’s final decision.
01-2-8120 In the Matter of Appeal of Denial of a Duplicate N.J. Firearms’ Purchaser Identification Card and Permits to Purchase In Name of List, App. Div. (per curiam) (4 pp.) Appellant appealed the Law Division order upholding the denial of his application for a duplicate firearms purchaser identification card and three permits to purchase handguns. The panel affirmed substantially for the reasons expressed below: two prior incidents in which a number of weapons had been removed from appellant’s home by associates of his, one a drug addict and another who was arrested, and appellant’s delay in reporting the thefts, indicated that issuance of the requested documents would be inimical to the public health, safety and welfare.
