Sent Home—A pro se plaintiff’s suit against Home Depot in federal court in Trenton has been dismissed based on her repeated lack of cooperation with court orders.

Cecelia Agabiti refused to turn over medical records relating to her alleged injury at a Home Depot store in Hamilton, and she refused to join conference calls with U.S. Magistrate Judge Lois Goodman, calling them “unproductive.” She failed to appear at court-scheduled conferences, despite warnings that an absence could result in dismissal. Agabiti wrote to Chief Judge Jerome Simandle to seek the removal of Goodman from the case, and accused lawyers at Hill Wallack, counsel for Home Depot, of falsifying a video of the accident.
