The Appellate Division in Williams v. Borough of Clayton (App. Div. Oct. 16, 2015) recently discussed the statutory constraints on police officer hiring and promotion in class three and four municipalities that have not adopted the Civil Service Act (CSA), N.J.S.A. 11A:1-1, et seq.

Maintaining a well trained and emergency-ready police department is an important area of public administration. Police officers are not prototypical civil servants; they are often a municipality’s first responders and risk their lives in efforts to combat and reduce crime. However, like other municipal government civil servants, police officers are not immune from the fiscal reality of today’s public administration climate: budget cuts, collective bargaining impasse, and reduced cost-of-living adjustments.
