Section 274A of the federal Immigration and Nationality Act (INA) sanctions employers who do not correctly verify their employees’ eligibility to work. Section 274A, added by the Immigration Reform and Control Act of 1986 (IRCA), and amended by the passage of the Immigration Act of 1990 and the Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) of 1996, was implemented to protect against unlawful employment.
Under Section 274A of the INA, all U.S. employers must verify work authorization by properly completing the Form I-9 and examining the appropriate documents for all employees including U.S. citizens, lawful permanent residents (LPRs or “green card holders”) and nonimmigrants (temporary visa holders) hired after Nov. 6, 1986.
