It is time to retire the phrase “meeting of the minds” from court opinions in New Jersey describing a supposedly necessary “element” of contract formation.
Roundly criticized by legal scholars for at least a century, the phrase misstates the law and, as recently evidenced, can lead to confusion and erroneous results.
