A federal judge in Camden has dismissed a food company’s suit claiming a competitor offered to buy a portion of its business as a ruse to obtain its burrito recipes and other trade secrets.

U.S. District Chief Judge Jerome Simandle of the District of New Jersey dismissed the suit by J&J Snack Foods of Pennsauken against Ruiz Food Products of Dinuba, California, finding that the letter of intent between the parties was not binding and that no implied covenant of good faith and fair dealing existed in the case under Delaware law, which the parties previously agreed would apply to the deal.
