In declining to transfer litigation over a noncompete agreement lodged by ADP against a 20-year veteran of the company, a federal judge didn’t have to look far.

“In sum, we have a New Jersey-based plaintiff that filed a lawsuit in its home forum pursuant to a forum selection provision,” U.S. Magistrate Judge Mark Falk of the District of New Jersey said March 29, noting that “less than a month ago, a senior district judge in this district denied a motion to transfer involving the same ADP forum selection clause.”
