A suit accusing a litigation partner at New Jersey’s Flaster/Greenberg of altering a client’s email and attempting to collect $650,000 in fees by means of extortion has taken a significant hit as discovery draws to a close.

U.S. District Judge Noel Hillman of the District of New Jersey on April 5 threw out a legal malpractice claim against the Cherry Hill-based firm. He denied the firm’s bid for summary judgment as to claims of fraud and breach of fiduciary duty, but he did so without prejudice, noting that it could refile the motion after discovery closes.
