The Administrative Office of the Courts is accused of stonewalling discovery in a suit claiming civil rights violations at Linden Municipal Court. Meanwhile, the plaintiffs allege evidence produced in the case so far suggests the court’s problems stem in part from the frequent absence of municipal prosecutor and state Sen. Nicholas Scutari, D-Union.
The AOC has yet to respond to a subpoena with a March 25 return date in Kirkland v. City of Linden, a suit claiming that Linden’s court routinely denied litigants’ right to counsel and that the judge regularly acted as the prosecutor. The AOC said it located 1,098 emails that responded to the request for documents relating to Linden court operations, but it considers all but six of them confidential. Plaintiffs counsel in the case has sought permission to file a motion to enforce the subpoena against the AOC.
