An attorney who was accused of misappropriating as much as $400,000 from an elderly relative’s estate is not liable for damages, even after the court found an “inference of mismanagement or misuse” of the funds, a federal judge in Newark has ruled.

John Sogliuzzo of West Orange does not owe damages because his sister, who brought the complaint, “failed to provide an accounting or other admissible evidence that defendant retained the cash for personal use or misappropriated the funds,” U.S. District Judge Susan Wigenton of the District of New Jersey said in Adkins v. Sogliuzzo.
