An appeals court has granted an emergent application for a mistrial in a legal malpractice case after the trial judge said one of the lawyers in the case could testify as a fact witness while continuing to represent her client.
A May 9 ruling by Superior Court Judge Charles Powers Jr., denying motions for a mistrial and for the disqualification of attorney Angela Roper, was reversed by the Appellate Division on May 10.
