Totowa attorney Angela Roper has asked a federal judge in Newark to rule that the bankruptcy court hearing the Chapter 7 case of her former law firm, Roper & Twardowsky, has no jurisdiction over $7.7 million that remains from a litigation settlement the firm forged with Prudential Financial Inc.

The Roper & Twardowsky Qualified Settlement Fund and Roper, as the fund’s trustee, moved on May 27 for leave to appeal a U.S. Bankruptcy Court ruling asserting jurisdiction over the fund. Roper, on behalf of the fund, claims that the bankruptcy court judge cannot assert jurisdiction over it because the state court judge that created the fund as a means to distribute settlement proceeds in the Prudential case has retained sole jurisdiction.
