The Appellate Division has reinstated a legal malpractice suit against the Cranford law firm Krevsky, Silber & Bergen, finding its alleged failure to communicate with its client is subject to the common knowledge exception to the affidavit of merit statute.
A trial judge dismissed the suit based on the failure of the plaintiff, Bayway Lumber Inc., to obtain an affidavit of merit in the malpractice suit, which stems from a failed real estate deal involving the plaintiff.
