Former Fox News host Gretchen Carlson has asked a federal judge in Newark to grant her judgment as a matter of law on her claim that an arbitration clause in her employment contract should not prevent her from litigating her sexual harassment suit against Fox News CEO Roger Ailes. Carlson is also asking the judge to order a stop to Ailes’ attempts to litigate their dispute in a New York court.

The clause in her 2013 employment contract with Fox News requiring arbitration of employment disputes refers only to corporate entities and does not apply to Ailes, Carlson said in motion papers filed July 18. The language of her employment contract gave Carlson no basis to understand that a direct claim against an individual would be subject to the arbitration clause, she said in court papers.
