“A poor parent who seeks to protect the fundamental right to raise a child, at a contested hearing, under the Adoption Act, is entitled to counsel under the due process guarantee of the New Jersey Constitution,” said the Supreme Court in a unanimous opinion authored by Chief Justice Stuart Rabner in In the Matter of the Adoption of a Child by J.E.V. and D.G.V. (A-39-15) (076767).
The NJSBA participated as amicus curiae in the matter along with four other amici. The brief was authored by NJSBA members Cheryl E. Connors, Brian G. Paul, and Amanda S. Trigg and Connors argued the matter.
