A lawsuit claiming that a strip club wrongly classified a dancer as an independent contractor has been tossed out by a federal judge in Newark.
Alissa Moon waived her litigation rights when she signed an employment contract containing an arbitration agreement, U.S. District Judge Susan Wigenton ruled July 29 when she granted summary judgment to Breathless Men’s Club, the Rahway establishment where Moon worked. The plaintiff’s claims that she was misclassified as an independent contractor are directly in conflict with the agreement’s provisions, which state that she is a contractor and not an employee, Wigenton ruled.
