A collective action alleging that Scotts Miracle-Gro employees tasked with tending to in-store displays were cheated out of overtime pay has found some room to grow, thanks to a New Jersey federal judge’s ruling.

The action’s opt-in period can include the yearlong window leading up to certification, which was granted earlier this year, according to an Aug. 4 decision by U.S. Magistrate Judge Joseph Dickson of the District of New Jersey granting a motion for equitable tolling of the statute of limitations.
