A New Jersey appeals court has ruled that law enforcement agencies have no obligation to reveal the identity or records of a person who may be or has been under investigation, but has not been arrested or charged with a crime.

In a published ruling released Aug. 31 in North Jersey Media Group v. Bergen County Prosecutor’s Office, the three-judge Appellate Division panel agreed with a trial judge that the state’s Open Public Records Act, or OPRA, which generally calls for broad disclosure, did not compel the prosecutor’s office to release documents about a person the newspaper group believed to be under investigation.
