An appeals court has ruled that a conflict of interest between a lawyer from New Jersey firm Capehart & Scatchard and a party to a business dispute doesn’t require an otherwise acceptable settlement to be thrown out.
A two-judge Appellate Division panel on Sept. 2 refused to nullify a settlement in a business dispute, even though the lawyer had once represented the owner of the adversarial party in financial and estate planning matters.
