A civil rights suit claiming a pattern of due process violations in Linden Municipal Court has been amended to name state Sen. Nicholas Scutari, the city’s municipal prosecutor, as a defendant—though Scutari has denied the document’s accusations.
According to the amended complaint in Kirkland v. DiLeo, filed Tuesday, Scutari frequently skips court or leaves before the court session is over. In Scutari’s absence, Municipal Judge Louis M.J. DiLeo, another defendant in the case, would act as both judge and prosecutor during criminal hearings, or allow others to serve as prosecutor, the suit claims.
