The Supreme Court, in its most recent term, decided three criminal cases that were particularly notable.
No Jury Trials for DWI
In State v. Denelsbeck, 225 N.J. 103 (2016), the court held that a defendant charged with a third or subsequent DWI offense is not entitled to a trial by jury under the Sixth Amendment. In so ruling, as Justice Albin observed in dissent, New Jersey remains the only state in the country that does not provide for the right to a trial by jury for any DWI offenses.
