Lawyers for affordable housing advocates and local governments argued before the New Jersey Supreme Court on Wednesday over whether hundreds of the state’s municipalities should be required to provide approximately 200,000 homes for low- and moderate-income residents in order to meet their constitutional fair-share housing obligations.

The issue is before the court because the now-defunct state Council on Affordable Housing, which was supposed to approve every local government’s affordable housing plans, failed to issue any regulations between 1999 and 2015.
