The U.S. Court of Appeals for the Third Circuit has dismissed a suit for legal malpractice and breach of fiduciary duty brought against the now-defunct Newark firm of Carpenter, Bennett & Morrissey by two former Rutgers University students.
The students claimed they formed an attorney-client relationship with Carpenter Bennett when the firm represented Rutgers in proceedings to revoke tenure from anthropology professor William Powers. They sued the firm after they were unhappy with terms of a settlement reached by Rutgers and Powers.
