Perhaps not so quietly, Judge Merrick Garland has resumed hearing cases on the U.S. Court of Appeals for the District of Columbia Circuit. Garland, a graduate of Harvard College and Harvard Law School, has been a member of that court since his appointment and confirmation in 1997, and its chief judge since February 2013.

The political machinations surrounding the nomination last March of Garland to the seat vacated by the late Supreme Court Justice Antonin Scalia are well-known, as is the debate about the president’s right to appoint a justice during a presidential election year and the Senate’s obligation to conduct confirmation hearings. A suit to compel a confirmation vote was dismissed for lack of standing.
