The U.S. Court of Appeals for the Third Circuit has asked the New Jersey Supreme Court to address an issue addressing job security for municipal attorneys.
In Armano v. Martin, the Third Circuit asked the state court for guidance Thursday on whether municipal council members in towns organized under the Faulkner Act can fire a municipal attorney based solely on an expressed loss of trust for behavior that is not illegal or unethical. The appeals court is seeking the input in a suit in which the solicitor for Washington Township is challenging his dismissal by the town council.
