The New Jersey Supreme Court is considering how much discovery prosecutors must provide to defendants if they are seeking to have those defendants held without bail pending trial under the state’s nascent bail reform system.

Prosecutors and defense lawyers squared off before the court on Wednesday to gain some clarity on the rules behind the new system, which allows judges to decide whether certain defendants, based on the nature of their alleged crime and their criminal histories, should be held without bail until their cases are heard, or released without having to post bail.
