Prosecutors and women’s-rights advocates last Wednesday asked the state Supreme Court to overturn an unpublished Appellate Division ruling that bars judges from issuing restraining orders for women fleeing abusive husbands in other states and seeking shelter in New Jersey.

Assistant Somerset County Prosecutor James McConnell said the Prevention of Domestic Violence Act, N.J.S.A. 2C:25-19a, does not bar women seeking to extricate themselves from abusive relationships to be state residents, nor does it mandate that the alleged abuse occur within the state’s borders.
