Richard Williams, administrative director of the courts, has filed a complaint seeking a declaratory judgment holding that a New Jersey statute, P.L. 2001, Chapter 362, is unconstitutional.

The statute requires the Administrative Office of the Courts to establish a “Probation Officer Community Safety Unit” composed of 200 probation officers, no fewer than five of whom are to be assigned to each county and all of whom are to be trained for law enforcement purposes. The unit members are authorized to carry guns and are empowered to enforce the state’s criminal laws.
