New Jersey courts have jurisdiction to issue restraining orders where an act of domestic violence occurred in another state but the victim has fled to New Jersey and is pursued by her assailant, the state Supreme Court ruled last Tuesday.
The unanimous ruling, in State v. Reyes, A-37-01, overturns an appellate panel that said a restraining order could not be entered based on an out-of-state assault. Justice James Zazzali wrote that the pursuit into New Jersey is an act of domestic violence over which New Jersey courts have jurisdiction under the Prevention of Domestic Violence Act, N.J.S.A. 2C:25-17 et seq.
