Although the Planning Board committed significant procedural and substantive errors in violation of the MLUL, including a failure to swear in certain witnesses and frequent, confusing changes of the rules during the hearings, the complaint attacking site-plan approval is dismissed, since the Board had little, if any, discretion to deny the application, which complied with all applicable zoning and site-plan ordinances, and many of the objectors were heard and their comments were taken into consideration.
