Casinelli v. Manglapus

A physician certification is neither a fundamental element of an Automobile Insurance Cost Reduction Act action nor analogous to a pleading and, therefore, a late filing is akin to a discovery violation and does not compel a dismissal with or without prejudice; the Appellate Division's affirmance of the denial of defendant's motion to dismiss the complaint with prejudice is affirmed.
