Prado v. State of New Jersey et al

A trial court in which an action against a State employee is pending has jurisdiction to review the Attorney General's denial of legal representation; the Attorney General is required to provide representation only if there is no realistic possibility that a judgment against the employee would warrant a finding that the act upon which liability was based was outside the scope of employment or involved actual fraud, actual malice or willful misconduct.
