Where the parties entered into a proposed settlement agreement (commonly called a "pay and go" settlement) requiring the defendant to vacate, the settlement is rejected since the notice to quit gives the tenant, who occupied the apartment prior to its conversion to a condominium, only two months' notice to surrender possession rather than the required three years, and there is no benefit to the tenant.
