Neither the New Jersey Antitrust Act nor the New Jersey Consumer Fraud Act provides a cause of action to the putative class plaintiff, an indirect, pass-through purchaser of Goodyear tires, against companies which produce, manufacture and sell carbon black (a primary ingredient in tires) for alleged price-fixing; the Law Division's denial of defendants' motion to dismiss the complaint under Rule 4:6-2(e) is reversed.
