Beltran v. DeLima et al, etc.

In light of the Supreme Court's decisions in DiProspero and Serrano , holding that N.J.S.A. 39:6A-8a does not require a "serious life impact" standard, the balance of policy considerations favor a finding of pipeline retroactivity, and these decisions are applicable to all prejudgment matters pending in the trial courts and to those matters on direct appeal.
