In determining when property was transferred for less than fair market value within three years of applying for Medicaid assistance (the "look-back" period), as opposed to determining the penalty to be imposed for property already determined to have been transferred during the look-back period, statutory and common law, and not regulations, apply; here, the date is the date the deed was executed, conveyed to her children, and accepted by them, not the date the deed was finally recorded.
