Workers bringing retaliation claims under New Jersey’s Law Against Discrimination bear the burden of proving the complaint that allegedly triggered the retaliation was reasonable and made in good faith, the state Supreme Court ruled last week.
The justices also held that employers’ investigative reports about employees are admissible nonhearsay evidence when an employer’s motivation is directly at issue.
