New Jersey’s Department of Environmental Protection can’t use its police and regulatory powers to collect an $800 million fine from a company in Chapter 11, a bankruptcy judge says.
U.S. Bankruptcy Judge Judith Fitzgerald found that the claim against W.R. Grace & Co. was a suit for money due, not a regulatory action warranting exemption from the automatic stay of 11 U.S.C. 362.
