Court ordered plaintiff's counsel to apologize to community members for distressing early-morning auditory test conducted as part of discovery in civil rights claim where counsel's conduct failed to recognize ethical obligations to public but barring the results of testing would not serve the interests of justice. Plaintiff's counsel ordered to issue formal written apology to the public.

Defendant appealed his judgment of conviction ordering him to serve a life sentence without parole for murder.
