"Because it had been so long since Mr. Balla got a surgical recommendation, we didn't think he was going to go through with it and have his surgery," defense counsel Michael Kenney of Freeman Mathis & Gary said. "The jury found it persuasive that the real reason he put it off is because he's a sole proprietor, an owner-operator trucker, and he was basically waiting until he just couldn't wait any longer to have the surgery."
