Savvy high net worths moving ever further away from publicly litigated divorce disputes, to mediation and other forms of out of court resolution (whether because they genuinely want to, or because of moves towards changing court rules so that people may be penalised if they litigate unnecessarily). My HNW/UHNW mediation practice has really grown in recent months and I fully expect that to continue. In children cases, more initiatives to educate people – clients, judges, lawyers – about the devastating impact on children of protracted, acrimonious litigation.
