New Suit

The Delaware Department of Human Resources, Delaware State Employee Benefits Committee (SEBC) and other defendants were sued Wednesday in Delaware Court of Chancery. The suit, filed by Bailey & Glasser on behalf of RiseDelaware Inc. and two Delaware retirees, seeks attorneys’ fees and an entry of final judgment. According to the petition, the plaintiffs sought a judicial determination that the defendants' decision to convert state retirees’ health care benefits from traditional Medicare to a Medicare Advantage plan was unlawful because the SEBC had failed to comply with the state's Administrative Procedure Act and had violated the Freedom of Information Act by failing to have open meetings. Counsel have not yet appeared for the defendants. The case is 2023-0230, RiseDelaware Inc. v. Secretary Claire DeMatteis.
