New Suit

Lewis Brisbois Bisgaard & Smith filed a lawsuit Wednesday in Delaware District Court against the Delaware Department of Safety and Homeland Security, its cabinet secretary and the superintendent of the Delaware State Police in relation to the state's House Bill 450, a recently-enacted law pertaining to the possession and sale of assault weapons. The law, also known as the Delaware Lethal Firearms Safety Act of 2022, prohibits the manufacture, sale, transfer, purchase, possession or transport of assault weapons in Delaware. The suit contends that Delaware violated the plaintiffs' rights under the Second and Fourteenth Amendments of the U.S. Constitution and that the state mislabeled common rifles and shotguns as 'assault weapons.' The lawsuit was brought on behalf of four rifle clubs and five Delaware citizens. The case is 1:22-cv-00951, Delaware State Sportsmen's Association, Inc. et al v. Delaware Department of Safety and Homeland Security et al.
