Foley & Lardner filed a lawsuit Tuesday in Florida Middle District Court on behalf of Dianne and Jay Higbee. The complaint seeks just compensation from the City of Jacksonville for using an underground drainage pipe on plaintiffs land to carry storm water to the St. Johns River. The suit, for damages, proceeds a state court claim in which the court ruled that the City did not have a written easement to use the drainage pipe. Counsel have not yet appeared for the defendant. The case is 3:22-cv-00366, Higbee et al v. City of Jacksonville.
