Former Schnader Harrison Segal & Lewis income partner Jo Bennett's suit against her now-shuttered firm for allegedly misappropriating salaried senior attorneys' compensation since 2018 has survived a motion to dismiss, according to an opinion posted by Eastern District of Pennsylvania Judge John Younge on Monday.Bennett filed her class action suit against Schnader and 34 of its equity partners back in February, claiming that the firm violated ERISA requirements and required eligible non-equity partners and counsel to defer a portion of their annual compensation into the firm's pension plan despite the pension plan not requiring such contributions.
