Texas landowners with mineral rights lost an argument over whether oil and gas producers should be able to deduct certain postproduction costs before paying royalties. The U.S. Court of Appeals for the Fifth Circuit, in an unpublished opinion, upheld the trial court's dismissal of a lawsuit brought against oil and gas producer Hilcorp Energy Co. The affirmation came after the Fifth Circuit sent two certified questions to the Texas Supreme Court.
