To Build Practice, Ex-Bush SG Embraces Liberal Clients

In George W. Bush's solicitor general's office, Paul Clement built a reputation as one of the most skilled appellate advocates of his generation as he argued the trickiest of cases before the U.S. Supreme Court and appellate courts. Now a partner at King & Spalding, Clement has taken on tough-to-win Supreme Court cases that are far from standard fare for a Bush-era legal icon. But Clement said his conservative political views have not changed: "I haven't had a conversion on the road to Damascus or anywhere else."

Branding is Law Firms' New Buzzword

Long a cornerstone of consumer marketing, the notion of branding is being stretched in a new direction these days by law firm consultants and their in-house counterparts. Despite all the effusiveness, though, no one seems to agree on exactly what branding is or how a law firm is supposed to do it. Nor is there yet any evidence that branding actually works in the legal business.

Does the Future Belong to Cadwalader?

Cadwalader, Wickersham & Taft has surged into the top ranks of profitability. Under Chairman Robert Link, the firm went through a controversial transformation into perhaps the nation's most aggressively profit-focused law firm. Today's Cadwalader, at which big producers are lavishly rewarded and underperformers are shown the door, presents a stark alternative to the more conservative ways of traditional top-tier firms. But the firm also has a reputation for ruthlessness that suits some but turns off others.

Associates Survey 2008

Smaller firms often outscore larger ones on our annual survey of midlevel job satisfaction. It may be because a more intimate atmosphere breeds happiness. Maybe it's because associates have more responsibility. Perhaps it's because they have a better chance of making partner. In these charts, firms are grouped roughly according to size. In the first category are firms whose annual gross revenues are too low to qualify for the Am Law 200. These are the smallest firms that took part in our survey. In the second category are Am Law Second Hundred firms?numbers 101-200 on the most recent Am Law 200 survey (July.) In the final category are firms that appear on our most recent Am Law 100 (May) or Global 100 (October 2007) survey. For a full methodology, click here.

A Field Guide to the Alito Confirmation Hearings

Even his closest friends say Supreme Court nominee Samuel Alito Jr. is a shyer, blander version of Chief Justice John Roberts Jr. Be that as it may, Alito's Senate confirmation hearings, which begin this week, are likely to be anything but dull. After a long holiday truce, the battle over Alito's nomination has flared up again. What had once shaped up as a one-note debate over abortion rights has been overtaken by a range of other issues, most notably executive branch power.

EPA Subpoena Refusal Is Reviewable

A federal agency's refusal to comply with a subpoena for documents in an action to which it is not a party may be reviewed by a district court, the 2nd U.S. Circuit Court of Appeals ruled. The court found the provisions of the Administrative Procedure Act calling for judicial review of agency actions amount to a waiver of sovereign immunity. The ruling means a federal judge can review the EPA's refusal to provide documents sought by General Electric in its defense of a suit over a New Jersey Superfund site.
