U.S. Supreme Court Reverses Fee Award Against Individual Defendant

In a unanimous opinion penned by Justice Ruth Bader Ginsburg, the U.S. Supreme Court ruled that a lower court abused its discretion in holding corporate officer Donald E. Nelson liable for attorneys' fees immediately after adding him as a party. The justices conceded that Nelson knew the complaint was amended to add him as a defendant, and that he might be subject to personal liability, but was nonetheless denied a fair chance to respond.
